Communication de GTT International: Participation of Madagascar to the Assembly of ICC

Regarding:

The Participation of Madagascar to the Assembly

Your Excellencies,

We seek to draw the attention of the members of states party to the Rome Statute of the International
Criminal Court (ICC) to recent events in Madagascar and to the participation of Madagascar’s High
Transitional Authority (HAT) de facto government in the conference of ICC.

It is now widely known that the current government in Madagascar gained power by a coup d’état in
2009. Since this time, many events which fly in the face of the standards set by the ICC have occurred.
We call your attention to events occurring within the last few weeks:

*On Wednesday, November 17, 2010, the Malagasy Army made a statutory declaration for the creation
of a “Military Committee for Public Salvation” (MCPS). This declaration sought to stop the trend of political deterioration which began with the coup by Mr. Andry Rajoelina
*On Saturday, November 20, 2010, while the MCPS was in negotiations with a representative of the government regime, Mr. Alain RAMAROSON’s private militias and Special Intervention Force attacked the military camp.

The coup leaders then took the following non-democratic actions against members of the opposition:

The former prosecutor for the International Criminal Court, Raymond Ranjeva, and his daughter, were arrested and prosecuted under the claim that the two were attempting to overthrow the government.

Thirty officers and MCP claimants, were deemed rebels by the HAT, imprisoned and tortured. General Raoelina, a witness against the High Transitional Authority’s (HAT) actions in the case of

February 7, 2009 (attack of the Palace in Antananarivo), is now in a comatose state having suffered a beating. We hear that Colonel Coutiti Assolant, member of MCP died following his treatment during his arrest.

President and Mayor-elect of the Association of Mayors of Madagascar, Guy Maxime Ralaiseheno, was brutally arrested and then incarcerated when he was about to speak at a peaceful demonstrators in area of Analakely;
Three political leaders of the legal opposition movement, Fetison Rakoto Andrianirina, Zafilahy Stanislas and Pastor Edouard Tsarahome were detained in an undisclosed location for several days. They were accused of being directly responsible for disturbances happening on Thursday, November 11, 2010.

The Malagasy people can no longer tolerate the intimidation, extortion, rape, and looting that the Rajoelina regime has inflicted during the last twenty months!

We denounce that such a government could have a place in your Assembly and we strongly feel that they should be barred from participation until the time that this regime follows the rules of international
conduct and respects the rights of Malagasy citizens.

We call upon the ICC to persuade all participating countries to bar the coup regime and their representatives from addressing the meeting in any way. Our information indicates that Mrs. Christine Razanamahasoa (Justice Minister of the HAT) will attend. Mrs. Razanamahasoa is the one who took the steps to prosecute Mr. Raymond Ranjeva and his daughter!

We beg of you to do what is right in this situation.
